These Website Terms (“Terms”) govern your use of websites, landing pages, forms, scheduling tools, and other online services operated by Vivify Custom Remodeling Inc. (“Vivify,” “we,” “us,” or “our”). By using these services, you agree to these Terms. If you do not agree, do not use the services.
Website content is provided for general information and marketing. It is not a construction contract, design agreement, scope of work, price quote, warranty, engineering opinion, permit determination, or promise of project timing. Product availability, dimensions, finishes, pricing, financing, permit requirements, installation conditions, and schedules vary. Only a written proposal or contract signed by Vivify and the customer controls a project.
Submitting a form or selecting a time requests a consultation; it does not guarantee or confirm an appointment. An appointment is confirmed only after Vivify communicates confirmation. We may contact you to verify service area, project type, property authority, decision-maker attendance, site conditions, and scheduling. We may reschedule or decline requests that are outside our service area or current capabilities.
Any preliminary price range is illustrative only. Final price, payment schedule, scope, exclusions, product specifications, warranty coverage, estimated timing, and cancellation rights are stated in the signed project documents. Financing is subject to lender approval and separate lender terms. Nothing on this website is a credit offer or guarantee of financing.
Nothing in these Terms waives a right that cannot legally be waived. Any applicable cancellation or rescission right is governed by California law and the notices and instructions delivered with your signed contract. Signing electronically does not by itself eliminate a cancellation right that otherwise applies.
When you submit contact information, you authorize Vivify to respond about your inquiry, requested consultation, appointment, or project using the contact methods you provide. Calls may be monitored or recorded where permitted by law. Marketing text consent is optional and is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of marketing texts and HELP for help. Use the unsubscribe link in marketing emails. Opting out of marketing does not prevent necessary transactional communications about an active request, appointment, or project, as permitted by law.
You may not misuse the services, interfere with their operation, attempt unauthorized access, submit unlawful or fraudulent information, impersonate another person, introduce malicious code, scrape or copy content at scale, or use the services in a way that violates law or the rights of others.
You represent that information, measurements, photographs, plans, or other materials you submit are accurate to the best of your knowledge and that you have authority to provide them. You grant Vivify a limited license to use submitted materials to evaluate your request, prepare a proposal, communicate with you, and provide services. We will handle personal information as described in our Privacy Policy.
Vivify’s website content, branding, text, graphics, page designs, and other materials are owned by Vivify or used with permission and are protected by applicable law. You may use the services only for personal, noncommercial evaluation of Vivify’s services. Product names and third-party marks belong to their respective owners.
Our services may link to or use third-party platforms, product catalogs, mapping, scheduling, financing, analytics, or communication tools. Vivify does not control third-party services and is not responsible for their content, availability, security, or terms. Your use of a third-party service may be governed by separate terms and privacy policies.
To the fullest extent permitted by law, the online services are provided “as is” and “as available.” We do not promise that website content will be complete, current, uninterrupted, error-free, or suitable for every property. Project workmanship and product warranties, if any, are only those stated in the signed Vivify contract and applicable product documents.
To the fullest extent permitted by law, Vivify will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the online services. Nothing in these Terms limits liability or consumer rights that cannot legally be limited.
We may update these Terms or modify, suspend, or discontinue online features. The effective date above identifies the current version. Continued use after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Nothing in these Terms prevents a consumer from using a forum or remedy available under applicable law.
